1. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 308 and 34 of the Indian Penal Code. 3. Learned counsel for the petitioners submits that petitioners no. 1, 2 and 3 have antecedent of two cases, petitioner no. 4 and 5 are persons with clean antecedent and petitioner no. 5 is a woman and the informant alleges that on 27.10.2021, at about 10:00 p.m., the accused persons including

No.67804 of 2025(3) dt.02-12-2025 2/3 the petitioners came and Mahesh Yadav caught his waist and his brother Sandeep Yadav assaulted him by rod causing injury on his head and thereafter Gaurav Yadav assaulted the informant by brick causing injury on his chest while Usha Devi abused and dashed his bhabhi on the ground. 4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that informant has implicated his entire family members including his father, brother and bhabhi. It is next submitted that on account of dispute relating to property, an altercation had taken place in which both sides assaulted each other.
It is also submitted that even presuming what has been alleged is true without admitting then the injury suffered by the informant has been opined to be simple in nature as would manifest from Annexure-2 series to the anticipatory bail application. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners. 6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on

Case No. 529 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
