Umrao, learned Standing Counsel. 2. By means of this petition filed under Article 226 of the Constitution petitioner has prayed for a direction in the nature of writ of mandamus to command the respondent No. 2 to consider the claim of petitioner for compassionate appointment on account of death of his father in harness on 06.06.2022 while he was working with respondent's establishment. 3. It is contended that petitioner's claim for compassionate appointment has remained pending consideration at the end of respondent No. 2 ever since the application was moved on 30.10.2023 and the delay has resulted in sever injustice in the matter and is certainly defeating the very object behind the rule of compassionate appointment. 4. Learned Standing Counsel has no objection in the event petitioner's application is directed to be disposed of, in accordance with law. 5. In such above view of the matter and in the light of principles of law laid down by Supreme Court as well as this Court in a number of decision that the matter of compassionate appointment is to be considered on priority basis as the bereaved family is to be provided with immediate succour and any delay for no justified reason, would certainly be defeating the very object for which the compassionate appointment rules were framed it is hereby provided that the respondent No. 2 shall take a Versus Counsel for Petitioner(s) : Akhilesh Kumar Dwivedi, Alok Kumar Dwivedi Counsel for Respondent(s) : C.S.C. Krishan Murari .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) final decision in the matter of claim of petitioner for compassionate appointment, as expeditiously as possible, positively within a period of two months of production of certified copy of this order. It is further provided that in the event claim of petitioner is found to be rightful and genuine, he shall be offered compassionate appointment within the next 30 days.
