Shri Anup Dhar Dubey, learned counsel for the petitioner and Shri Awadhesh Kumar Patel, learned Standing Counsel for the State-respondents are present. 2. By means of the present writ petition, the petitioner has prayed for the following relief:- "1. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents, respondent no. 3 Sub Divisional Magistrate, Rudrapur, Tehsil Rudrapur, Pargana Rudrapur, district Deoria to stop the threatening to the petitioner for dispossession from her half share in Bhumidhari land bearing Gata no. 409 total area 0.5830 hectare situated in village Korawan (Silhat), Tehsil Durdrapur, district Deoria." 3. This Court vide order dated 29.9.2024 granted time to learned Standing Counsel to seek instructions in the matter. 4. Shri Awadhesh Kumar Patel, learned Standing Cousnel appearing on behalf of State has placed before this Court the instructions dated 30.9.2024 received under the signatures of Sub Divisional Officer, Rudrapur, district Deoria. The copy of the said instructions is taken on record. The relevant portion of the same is extracted below for ready reference :- "गग्राम ककोरवग्राव, परगनग्रा ससिलहट, तहसिसील रूद्रपपुर, जनपद ददेवररयग्रा ककी आरग्राजसी सिवख्यग्रा 409/0.583 हदे0 पर रग्राजस्व अभभिलदेख खततौनसी ककी खग्रातग्रा सिवख्यग्रा 00088 मम अवभकत हह, सजसिमम मपु० दपुलग्रारसी पत्नसी भिभिभूतसी कग्रा नग्राम मभूल खग्रातदेदग्रार मम हह, आददेशको कदे भववरण कदे ककॉलम मम सिवख्यग्रा 16 पर आददेश नग्रायब तहसिसीलदग्रार महदेन न्यग्रायग्रालय आददेश भदनग्रावक 23.09.2017 कलग्रावतसी ददेवसी बनग्राम भिगदेलभू अन्तगरत धग्रारग्रा 34 मम गग्राटदे कदे 1/2 भिग्राग भवकदे तग्रा भिगदेलभू पपुत्र भिभिभूभत कग्रा नग्राम खग्राररज करकदे कदे तसी कलग्रावतसी ददेवसी पत्नसी रग्रामशश्रृगग्रावर भनवग्रासिसी गग्राम ददेवकलसी हदेमरग्राज यग्राचसी कग्रा नग्राम अभभिलदेखको मम दजर हह। मतौकदे पर 1/2 भिग्राग पर यग्राचसी वतरमग्रान मम कग्राभबज हह। यग्राचसी नदे अपनदे यग्राभचकग्रा कदे भवभभिन्न प्रस्तररों मम अभभिलदेखरों ककी सस्स्थित कग्रा वणरन करतदे हहए तस्थिग्रा अपनग्रा कब्जग्रा दशग्रारतदे हहए प्रभतयग्राचसी सिवख्यग्रा 03 दग्रारग्रा मतौसखक रूप सिदे बदेदखल करनदे ककी बग्रात रखसी हह। यग्राभचकग्रा कदे अन्त मम प्रभतयग्राचसी सिवख्यग्रा 03 कको भवषयगत गग्राटग्रा सिवख्यग्रा 409 पर यग्राचसी कदे कब्जदे सिदे यग्राचसी कको बदेदखलसी ककी धमककी न ददेनदे कदे सलए भनदरभशत करनदे ककी मग्रा० न्यग्रायग्रालय सिदे यग्राचनग्रा ककी हह। उक्त कदे कम मम अवगत करग्रानग्रा हह भक उपरकोक्त प्रकरण मम प्रभतयग्राचसी सिवख्यग्रा 03 कदे न्यग्रायग्रालय मम भकसिसी भिसी प्रकग्रार कग्रा बदेदखलसी वग्राद वतरमग्रान मम प्रचसलत नहहीं हह। भिभूभमधरसी भिभूभम मम बदेदखलसी कग्रा वग्राद उ०प्र०रग्रा०सिवभहतग्रा-2006 ककी धग्रारग्रा 134 कदे तहत सिम्पग्राभदत ककी जग्रातसी हह। यग्राचसी दग्रारग्रा न तको अपनसी यग्राभचकग्रा मम भकसिसी सिग्राक्ष्य कको सिवलग्न भकयग्रा हह , और न हसी अब तक ककोई सिग्राक्ष्य प्रभतयग्राचसीगण कको प्रस्तपुत भकयग्रा हह। बदेदखलसी ककी कग्रायरवग्राहसी सिवबवसधत ककोई भिसी सिग्राक्ष्य उपलब्ध नहहीं हह। प्रभतयग्राभच सिवख्यग्रा-03 दग्रारग्रा यग्राचसी कको भकसिसी भिसी प्रकग्रार ककी धमककी नहसी दसी जग्रा रहसी हह।" 5. On the basis of the aforesaid written instructions, learned Standing Counsel has made a categorical statement before the Court that petitioner has never been threatened by respondent No. 3, as alleged in the writ petition. 6. In view of the aforesaid statement made by the learned Standing Counsel as well as the written instructions quoted herein above, this Court is of the view that prayer made in the writ petition has been adequately answered and as such no useful purpose would be served in keeping the present writ petition pending. 8. Accordingly, the instant writ petition is disposed of in light of the instructions quoted herein above.
