JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 4 25-11-2025 Heard both parties. 2. The petitioner seeks bail in a case, registered for the offence punishable under Sections 109(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act. 3. Prosecution case, in brief, is that petitioner along with co-accused abused the informant and snatched his fish and net. When the informant protested, co-accused Ankit Rai caught hold of informant and co-accused Rahul Rai shot him with pistol. 4. Learned counsel for the petitioner submits that petitioner is named, but no specific role has been attributed against him. Allegation of firing is against other co-accused. Petitioner is in custody since 04.04.2025. 5. Learned APP however, vehemently opposes the Patna High Court CR. MISC. No.51196 of 2025(4) dt.25-11-2025 2/2 prayer for bail of the petitioner. 6. Considering the aforesaid facts and period of custody, let the petitioner above-named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bhojpur at Ara in connection with Dhobha P.S.
