The petitioner has been made accused in connection with Mango (Olidih) P.S. Case No. 117 of 2023, corresponding to G.R. Case No. 1128 of 2023, S.T. Case No.557 of 2023, for the offence registered under Sections 342, 302, 147, 148 & 149 of the Indian Penal Code and Section 27(3) of the Arms Act and as per impugned order, trial under Sections 302/34 I.P.C & Sections 25(1-B)(a), 26 & 35 of the Arms Act, pending in the court of learned Additional Sessions Judge-II at Jamshedpur. Bail application of the petitioner was earlier rejected by this Court in B.A. No.5571/2024, vide order dated 23.08.2024. Petitioner is the main assailant of the deceased and it is alleged that he had shot the deceased resulting into his death. Stage of the trial, earlier called for, from the learned Trial Court has been received. It appears that the prosecution has examined eleven witnesses and two witnesses remain to be examined. In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected. Learned Trial Court shall take all possible steps to conclude the trial within four months, failing which, petitioner if so, advised may renew his prayer for bail. (Ambuj Nath, J.) BS/-
