This appeal is directed against the order dated 27.01.2025 passed in B. P. No. 3 of 2025 arising out of Nawa Bazar P. S. Case No. 77 of 2024 by the learned Additional Sessions Judge V, Palamau at Daltonganj whereby and whereunder the prayer for bail of the appellant has been rejected. It has been alleged that the grand daughter of the informant was kidnapped and suspicion was raised upon Suday Bhuiyan and Raju Bhuiyan. Submission has been advanced by the learned counsel for the appellant that one of the similarly situated co-accused namely, Suday Bhuiyan has been granted bail by this court in Cr. Appeal (DB) No. 515 of 2025. It has further been submitted that the main allegation of abduction and recovery of the child is upon Raju Bhuiyan. He further adds that the appellant is in custody since 03.11.2024. Learned A.P.P. for the State has opposed the prayer for bail of the appellant and has submitted that the appellant was the accomplice of the main accused – Raju Bhuiyan. -2- However, considering the fact that one of the similarly situated co- accused has been granted bail by this court, we while setting aside the order dated 27.01.2025 passed in B. P. No. 3 of 2025, direct that the appellant above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate 1st class, Palamau in connection with Nawa Bazar P.
