Heard Sri Vijay Gautam, learned Senior Advocate assisted by Ms. Atipriya Gautam, learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. By means of this petition filed under Article 226 of the Constitution, the petitioner has prayed for following reliefs: "a. Issue, a writ, order or direction, in the nature of mandamus, directing the Respondent Authorities, to pay the pension and other benefits to the petitioner, (after calculating the training period) and treating the petitioner continuity in his services, since his initial date of appointment, and add the earlier service period of Indian Army, in pursuance of the Government orders 17/02/2022 & 21/01/2016, with all consequential benefits. b. Issue, a writ, order or direction, in the nature of mandamus, directing the Respondent Authorities, to consider the grievances of the petitioner, and to pass appropriate orders within stipulated time, with regard to paying the pension and other benefits to the petitioner, (after calculating the training period) and treating the petitioner continuity in his services, since his initial date of appointment, and add the earlier service period of Indian Army, in pursuance of the Government Orders dated 17/02/2022 & 21/01/2016, with Versus Counsel for Petitioner(s) : Ambuj Maurya, Atipriya Gautam, C.S.C., Rishabh Kesarwani Counsel for Respondent(s) : Anoop Singh .....Petitioner(s) State Of U.P. And 7 Others .....Respondent(s) all consequential benefits." 3. It is argued on behalf of the petitioner that since the appointment pursuant to the selection in the year 2005-06 were made in the year 2009, Government came to issue a Government order on 21.01.2016 specifically directing for benefit of Assured Career Progression etc. by adding the previous service rendered in armed forces. Relevant Clause 3(1) of the Government order dated 21.01.2016 is reproduced hereunder: "(1) वषर् 2005-06 में आरक्षी ना०पु०/ आरक्षी पीएसी / रेिडयो अनुरक्षण अिधकारी सहायक पािरचालक कमर्शाला कमर्चारी पुिलस रेिडयो िवभाग की भतीर् को शासनादेश िदनॉक 09.2007 द्वारा सेवा से बखार्स्त िकये गये तथा शासनादेश िदनॉक 26.05.2009 द्वारा सेवा में पुनः िलये गये किमयों की सेवा से पृथक रहने की अविध को सेवा में िनरन्तरता मानते हुये असाधारण अवकाश स्वीकृ त कर िविनयिमत िकया जायेगा, िकन्तु मा० उच्चतम न्यायालय के "काम नहीं तो वेतन नहीं" के िसद्धान्त के अनुसार इस िविनयिमत अविध के वेतन एवं भत्ते देय नहीं होगे, िकन्तु वषर् 2006 से सेवा को िनरन्तर मानते हुये पेंशन, उपादान, वािषक वेतन वृिद्ध तथा पदोन्नित का लाभ व ए०सी०पी० का लाभ अनुमन्य होगा एवं उक्त के अितिरक्त ऐसे आरक्षी, जो प्रिशक्षण पूणर् करने से पहले ही बखार्स्त हो गये तथा उन्होंने शासनादेश िदनांकः 26.05.2009 द्वारा बहाल िकये जाने पर पूरक प्रिशक्षण पूणर् करके िदनांक 15.02.2010 को आरक्षी पद पर प्रभार िलया है। ऐसे सभी आरिक्षयों को भी प्रिशक्षण अविध को वषर् 2005 तथा वषर् 2006 प्रथम बैच के आरिक्षयों की भॉित प्रिशक्षण अविध िनधार्िरत करके इन याचीगणों को भी वषर् 2007-08, 2008-09 एवं 2009-10 की वेतन वृिद्धयाँ काल्पिनक रूप से अनुमन्य होगी। उपरोक्त िनणर्य के वल वषर् 2005-06 की पुिलस भतीर् प्रकरण की गम्भीरता एवं मा० सवोर्च्च न्यायालय / मा० उच्च न्यायालाय द्वारा पािरत आदेशों के आलोक में िलया जा रहा है। अतएव इसे अन्य प्रकरणों में दृष्टांत नहीं माना जायेगा।" 4. It is submitted that in above regard petitioner has already represented the matter before the competent authority on 11.05.2025, a copy whereof has also been brought on record as Annexure-11 to the writ petition. WRIA No. 13997 of 2025 2 5. Learned Standing Counsel submits that the matter can be directed to be examined by the competent authority in the first instance. 6. In view of the above, this petition stands disposed of with a direction to the respondent No.- 5 to look into and consider the grievance of the petitioner in reference to the Government orders dated 17.02.2022 and 21.01.2016 referred to hereinabove and dispose of same strictly in accordance with law within a period of two months' time from the date of production of certified copy of this order. 7.
