Satyen Vaidya, Judge (Oral). The respondents have filed supplementary affidavit dated 14.05.2024 and thereafter instructions dated 25.05.2024 have also been placed on record.
2. From the above documents, the respondents have stated that the Departmental Screening Committee in its meeting dated 27.07.2021 had found the petitioner eligible for compassionate appointment. It has also been stated that it may take considerable time for offering appointment to the petitioner as at present there is no vacancy available under 5% quota. As and when vacancy will arise under the said 1 Whether reporters of the local papers may be allowed to see the judgment?
quota, the PCCFF (HoFF) will intimate the same to the government.

The stand of respondents thus is though the petitioner is eligible for being appointed on compassionate ground but for the time being he cannot be offered appointment for lack of vacancies under 5% quota. The respondents are ready to offer appointment to the petitioner on compassionate ground as and when the vacancy will be available.

In view of the stand of the respondents, learned counsel for the petitioner seeks permission of this Court to withdraw the instant petition at this stage with liberty to approach this Court at appropriate stage for redressal of his grievance, if need so arise. Prayer being innocuous is allowed. Accordingly, the instant petition is dismissed as withdrawn with liberty as prayed for. Pending applications, if any, also stand disposed of.
