AT CHANDIGARH. 115 LPA-2634-2025 (O&M). Date of Decision: 01.09.2025. State of Punjab and others ....Appellants. VERSUS Wazir Singh ....Respondent. *** CORAM : HON'BLE MR. JUSTICE ANUPINDER SINGH GREWAL HON'BLE MR. JUSTICE PARMOD GOYAL --- Present: Mr. Akhil Kamra, Assistant Advocate General, Punjab for the applicants/appellants. **** ANUPINDER SINGH GREWAL, J. (Oral) CM-6623-LPA-2025 This application is for condonation of delay of 77 days in filing the appeal. Heard. For the reasons stated in the application, the same is allowed and delay of 77 days in filing the appeal is condoned. CM-6624-LPA-2025 Exemption application is allowed, as prayed for. LPA-2634-2025 The appellants have challenged the judgment of the Single Bench dated 14.05.2025 passed in CWP No.11849 of 2017 titled Wazir Singh vs. State of Punjab and others, whereby they have been directed to consider the claim of the respondent for regularization of his services. 2. Learned counsel for the appellants submits that the respondent did not have the essential qualification for the post of ‘Pump Operator’ and, therefore, he cannot be considered for regularization. JITENDER 2025.09.01 17:22 I attest to the accuracy of this document LPA-2634-2025 (O&M) -2- 3. Heard. 4. The respondent is stated to have been appointed by the appellant- Department as a ‘Pump Operator’ in the year 1992 on muster roll basis. He had passed his 10th Class at the time of his appointment while the essential qualification for the post of ‘Pump Operator’ is stated to be ‘Matriculation along with Certificate of One Year Course of ITI’. The respondent does not have the Certificate of One Year Course of ITI. However, there is no denying that the respondent has been working on the post of Pump Operator for over three decades and, therefore, he cannot be ousted from consideration for regularization merely on the ground that he does not possess the qualification prescribed for the post. The respondent has gathered experience of over 30 years as a Pump Operator and there is no material on record to indicate that his work and conduct was not satisfactory. 5. Consequently, we do not find any manifest illegality in the judgment of the Single Bench directing the appellants to consider the claim of the respondent for regularization of his services under relevant policy and not reject the same on the ground that he does not have the requisite qualification for the post, warranting interference by this Court. The Letters Patent Appeal being devoid of any merit stands dismissed. Pending application(s), if any, also stand disposed of.
