2025:UHC:6789 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS 01.08.2025 WPMS/2293/2025 Hon’ble Manoj Kumar Tiwari, J. Mr. Dushyant Mainali, Advocate for the petitioners. 2. Mr. Puran Singh Bisht, Additional Chief Standing Counsel and Mr. Sushil Vashistha, Standing Counsel for the State of Uttarakhand / respondent nos. 1 to 5. 3. Petitioners have filed this writ petition, seeking the following relief:- “i) Issue a writ of certiorari quashing the order dated 02.02.2024 (Annexure 1) passed by the respondent no. 4 passed in Revenue Demarcation Case No. 5 of 2023 as well as the notice dated 18.03.2025 (Annexure No. 2) passed by the respondent no. 5, including the entire proceedings of Revenue Demarcation Case No. 5 of 2023, pending before the court of Assistant Collector, 1st Class, Rishikesh, District Dehradun/respondent no. 5.” 4. The order dated 02.02.2024, which is challenged, is enclosed as Annexure-1 to the writ petition. By the said order, time was granted to all the persons, to whom notices were issued regarding demarcation proceedings, to file objection to the preliminary report. 5. Petitioners have also challenged the notice dated 18.03.2025, issued by Revenue Inspector, Tehsil Rishikesh, District Dehradun. 6. Perusal of the said notice reveals that all the stakeholders in the land in 2025:UHC:6789 question were asked to remain present during demarcation. 7. Learned State Counsel is right in pointing out that no prejudice is caused to petitioners, either by order dated 02.02.2024 or by notice dated 18.03.2025. Thus, this Court do not find any reason to interfere with the order and notice, impugned in this writ petition. 8. The writ petition is, however, disposed of, by directing to Assistant Collector concerned to decide the objections filed by petitioners and other stakeholders, within six months from the date of production of certified copy of this order.
