A.G., Haryana. **** SANDEEP MOUDGIL, J (ORAL) This writ petition has been filed under article 226/227 of the Constitution of India with a prayer that this Court may issue a writ in the nature of mandamus be issued directing the respondents to regularize the services of petitioner on the post of Sweeper under policy dated 18/20.06.2014 (Annexure P- 2) at parity with colleagues of the petitioner and to further direct the respondents to release the arrears of difference due and drawn of salary along with 18% interest to the petitioner.
Learned counsel for the petitioner submits that the petitioner was appointed as a Sweeper on 05.01.2011 on contract basis in Government Civil Hospital, Hisar through the Employment Exchange after due selection process. CWP-25720-2025 (O&M) 2 filed seeking regularization of his services in terms of policy dated 18/20.06.2014, claiming parity with his colleagues whose services have already been regularized. Be that as it may, this Court takes note of the fact that status quo with regard to services has been ordered by the Hon’ble Supreme Court in SLP No. 31566-2018 titled ‘The State of Haryana and Others v. Yogesh Tyagi and Another.’ However, in case the petitioner moves an application for
consideration of his case for regularization on the basis of the length of service rendered, the same shall be sympathetically considered, as is assured by learned State Counsel. This Court is further conscious of the fact that the petitioner has been discharging duties for more than 14 years merely as a Sweeper on contractual basis, which itself demonstrates the regular need of such services and availability of work in the establishment, namely Civil Hospital, Hisar. It is, thus, directed that till a regular incumbent is appointed against the sanctioned post, the services of the petitioner ought not to be dispensed with. Petition stands disposed of with above mentioned observations.
