CMP(M) No. 332 of 2024 The present application for condonation of delay in filing the appeal has been preferred against judgment dated
18.09.2023. The delay is stated to be of 118 days. The application has been opposed by the respondents-State more on the merits of the case, rather than the cause given in the application, wherein it has been mentioned that certain information had to be obtained regarding the resolution as such from Gram Panchayats to open Sub Tehsil at Tattapani, under the RTI Act, 2005 and in that process, considerable time took place. The application is duly supported by the affidavit of Prem Lal Sharma, who is President of the appellant-Samiti. In such circumstances, sufficient cause has been made out to condone the delay in filing the appeal. Accordingly, the application is allowed and the delay in filing the appeal is condoned. The application stands disposed of. LPA No. of 2025 Appeal be registered.
Issue notice. Mr. Arsh Rattan, learned Deputy Advocate General, accepts notice on behalf of the respondent. Now to come up for consideration on 01.04.2025.
