HIGH COURT OF JUDICATURE AT ALLAHABAD APPLICATION U/S 529 BNSS No. - 3654 of 2025 Court No. - 83 HON'BLE AVNISH SAXENA, J. 1. Heard Sri Yogesh Tiwari, learned counsel for the applicant and learned A.G.A. for the State. 2. Learned counsel for the applicant submits that the present application under Section 529 B.N.S.S. has been moved by the applicant/complainant for expeditious disposal of the matter under Section 138 Negotiable Instrument Act, pending since the year 2015. It is further submitted that the opposite party no.2 is kept on lingering the case on one pretext or the other. It is further submitted that the trial court is passing the order cursory without considering that the matter is one of the oldest in its category. 3. Learned A.G.A. accepts notice for the State. 4. There is no point in summoning of the opposite party no.2, as the prayer is to expedite the matter. 5. This Court has taken into consideration the rival submission made by the parties and perused the record. 6. The record reveals that despite the matter being of 2015, the non- bailable warrants have been issued against the opposite party no.2, which shows that the callous attitude of opposite party no.2 in getting the case disposed of. Hence, the trial court is directed to expedite the Complaint Case No.1458 of 2019 (Old Case No.598 of 2015), Preetam Anand Singh Versus Counsel for Applicant(s) : Yogesh Tiwari Counsel for Opposite Party(s) : G.A.
