GP FOR REVENUE (AP) The Court made the following: ORDER:- Heard Sri M.R.K.Chakravarthy, learned counsel for the petitioners and learned Assistant Government Pleader for Revenue. 2. Challenging the order of the 3rd respondent/Tahsildar dated 22.01.2020 in Roc.No.38/2020/(SA) under Sections 3 & 4 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 and the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007, the present writ petition is filed. 2 3. It is contended by the learned counsel for the petitioners that the notice was addressed to the deceased husband of the 1st petitioner. In support of their contention, the petitioners draw the attention of the Court, copy of the death certificate, which reflects the death of the deceased husband of the 1st petitioner as 25.04.2019. 4. In that view of the matter, since the notice is issued to a dead person, the same is nonest and not sustainable. Accordingly, the same is set aside. However, liberty is granted to the respondents, to proceed in accordance with law, if advised. 5. Accordingly, the writ petition is allowed. There shall be no order as to costs.
