1. Petitioner, an accused in case FIR No.77 dated 18.06.2021, u/s 21/25 of the NDPS Act, registered at Police Station Sadar Jagraon, District Ludhiana, has filed the present petition under Section 528 of BNSS, 2023, vide which he has prayed for quashing of the impugned order dated 11.07.2024 (Annexure P- 1), passed by Ld. Additional Sessions Judge, Ludhiana in the aforesaid FIR, vide which his (petitioner) bail was cancelled, bail bonds/surety bonds were cancelled/forfeited and his presence was sought to be procured by non-bailable warrants.

Learned counsel for the petitioner contends that petitioner, who has been falsely implicated in the present case, was granted the concession of bail by the Ld. ASJ, Ludhiana in terms of the order dated 30.07.2021. Since then the petitioner had been regularly appearing in the Court, however, on 11.07.2024, on account of being in custody in some another case (DDR No.14 dated 07.07.2024, u/s 129/170 of BNSS, 2023, P.S. Sadar Jagraon, District Ludhiana), he could not appear before Ld. Court, resulting in passing of the impugned order. CRM-M-48676-2025 -2- was released on bail only on 17.07.2024. Crux of the submission raised by learned counsel for the petitioner is that absence of the petitioner on 11.07.2024 was not intentional but was on account of the circumstances beyond his control (petitioner being in custody in some other case).

4. Resultantly, in view of the discussion made above, impugned
order dated 11.07.2025 is hereby set aside with a direction to the petitioner to appear before the Court concerned within a period of two weeks from today. On his appearance, he shall be granted concession of bail by the learned trial Court.
