This is an application filed by the petitioners praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending their arrest for the offences under Sections 115(2)/ 126(2)/ 109/352/ 351(2)/ 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023.

Learned counsel for the petitioner submits that because of the land dispute the entire occurrence had taken place. He submits that there is a counter case also filed by the petitioner.

Learned A.P.P. opposes the prayer for anticipatory bail of the petitioner.

After going through the records, I find that Abhisekh Kumar Yadav sustained injury on the vital part of the body and he was assaulted by this petitioner and others. The nature of injury is grievous.

Considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Bhawnathpur P.S. Case No.13 of 2025, pending in the court of learned J.M., 1st Class, Nagar Untari at Garhwa stands rejected.
