JUSTICE SHAILENDRA SINGH ORAL ORDER 2 25-11-2025 The instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking the following reliefs :- “(i) That this is an application for issuance of Writ in the nature of mandamus to direct respondent No.2 District Magistrate, Saran at Chapra, to dispose the application dt.13.9.2025 filed by the Petitioner to pay compensation amount for the land of the Petitioner acquired by the respondent concerned for development of double daker. Whereby and Whereunder purchased land of the Petitioner Which is situated N.H.-19 North Side Circle No.13, Holding No.492 property no.801333006573 Rakba 7.5.dhur Mohalla Salempur old ward No. 14 And Patna High Court CWJC No.19021 of 2025(2) dt.25-11-2025 2/3 New Ward No.26 Distt. Saran at Chapra, but respondent concerned neither given any notice to the petitioner for acquired of the aforesaid land nor given any compensation to the Petitioner, which is Illegal against bad in eye of law. (ii) For issuance of any other relief or reliefs for which Petitioner is entitled in this case.” 2. Mr. Vijay Kumar, learned counsel for the petitioner and Mr. S. Raza Ahmad, learned AAG-5 for the State- respondents, are present and they are heard. 3. It is submitted by petitioner’s counsel that the petitioner’s land is situated near NH-19 adjacent to North side of Circle No. 13, Holding No. 492, Mohalla- Salempur, old Ward No. 14 & New Ward No. 26, Dist.- Saran at Chapra, of which area is 7.5 dhur and he purchased the said land and paid rent to the Municipal Corporation, Chapra, which shows the petitioner’s title to the said land. It is further submitted that the petitioner’s land has been acquired by the District Land Acquisition Officer, Saran (respondent No. 3), for the development of Double Decker Bridge and the petitioner has not been given compensation and even he has not been given any notice before acquiring his land. It is further submitted that the petitioner has filed several representations before the concerned authorities and his last representation dated Patna High Court CWJC No.19021 of 2025(2) dt.25-11-2025 3/3 11.09.2025 was filed before the District Magistrate, Saran at Chapra (respondent No. 2), by way of Annexure- ‘P/5’ but even then he has not been given any relief. 4. After hearing both the sides, this Court is of the view that the issue raised by the petitioner in this writ petition is premature for consideration under writ jurisdiction of this Court, however, the District Magistrate, Saran at Chapra (respondent No. 2), is directed to dispose of the petitioner’s representation dated 11.09.2025, as per the provision of law, within four weeks from the date of receipt of a copy of this Court’s order or production of the same.
