JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 3 22-09-2025 Heard learned counsel for the parties. 2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 126(2), 115(2), 127(2), 134, 303(2), 351(2) & (3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. As per prosecution case, petitioner and his three associates riding on two motorcycle suddenly surrounded informant’s brother and attempted to snatch key of his motorcycle and when brother of informant protested and raised hulla, petitioner and his associates started assaulting him. Accused persons took away Rs.20,000/- from the pocket of informant’s brother. During commission of alleged offence, victim identified one of the accused persons as petitioner. 4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No specific overt act has been alleged against this petitioner. 5. Learned counsel for the State opposes the prayer for bail. He submits that the petitioner is named in the FIR with Patna High Court CR. MISC. No.60368 of 2025(3) dt.22-09-2025 2/2 specific allegation that he along with three accomplices overpowered informant’s brother, assaulted him and snatched cash Rs.20,000/-. Victim claims to have identified this petitioner on the spot. Moreover, petitioner has got three criminal antecedent. 6. Considering the nature of accusation and criminal antecedent of the petitioner, prayer for bail of the petitioner is rejected. Shashi (Prabhat Kumar Singh, J) U T
