1. Mr. Akash Sanyal, learned counsel holding the brief of Mr. Aditya Singh, learned counsel for the applicant.

3. The present applicant ‘Kulveer Singh’ S/o Sukhvinder Singh is praying for bail in relation to First Information Report dated 22.08.2023 bearing FIR No. 453 of 2023 PS Patel Nagar District Dehradun, wherein, the present applicant has been implicated along with 19 others for the offences punishable under Sections 420, 465, 467, 468, 471 and 506 of IPC r/w Section 120B of IPC.

It is contended by the learned counsel for the applicant that the applicant is in judicial custody since 16.06.2025 and the allegation relates to the gift deed in which the applicant is only the witness and the main executor of the gift deed is the father of the applicant who is in jail. He submits that the applicant’s role is only as a witness and he has nothing to do with any transaction, if any. He also submits that even he is not the power of attorney holder and simply he is the witness. Apart from this, he submits that the applicant has no previous criminal history.
5. On the other side, learned State counsel have not disputed this fact that the applicant has no previous criminal history and he is simply the witness of the gift deed. He submits that this is a case in which the power of attorney on the basis of which the gift deed was executed was found to be forged one.
6. After hearing the arguments of learned counsel for the parties and further taking into
consideration that the applicant is only the witness of the gift deed and is languishing in jail since 16.06.2025 and has no previous criminal history, this court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.

8. Let the applicant ‘Kulveer Singh’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
9. It is made clear that grant of bail to the present applicant will not be treated as a precedent at all in respect of the other co-accused, who are named in the FIR.
