(Oral) The present petition has been instituted by the petitioner seeking the release of his wife Manjeet Kaur who he alleges has been unlawfully detained by respondents No.4 to 6. It is contended by the counsel for the petitioner that the petitioner as well as detenue Manjeet Kaur were courting each other and solemnised their marriage as per Hindu rites and ceremonies. He submits that being an inter-caste marriage, the same was not acceptable to respondents NO.4 to 6 and consequently, they forcibly took away Manjeet Kaur on 21.08.2025 thus resulting in institution of the present petition to RAJ KUMAR ARORA 2025.09.05 18:05 I attest to the accuracy and integrity of this document CRWP-9425-2025 (O&M) -2- secure her release. The matter came up for hearing before this Court on 28.08.2025 when the Station House Officer (SHO), Police Station Kalayat, District Kaithal, was directed to ensure protection of detenue Manjeet Kaur. On resumed hearing today, detenue has been produced. Respondents No.4 to 6, father, mother and brother of the detenue are also present. This Court put a specific query to the detenue, Manjeet Kaur, as to whether she recognises the petitioner Gurjeet Singh. In response, she affirmed that he is her legally wedded husband. A further pertinent question was also put to her as to whether she desires to stay in her parental home or intends to stay in the matrimonial home. To this she expressed her willingness to go to her matrimonial home with her husband. Statement of the detenue has also been recorded separately which is taken on record as Mark ‘A’. Having heard the counsel for the respective parties and taking into account the specific intent of detenue Manjeet Kaur who is married and has expressed her willingness to go with her husband, I deem it appropriate to dispose of the present petition accordingly. The respondents are directed to hand over custody of detenue Manjeet Kaur to Gurjeet Singh petitioner. She would be at liberty to go her matrimonial house. September 04, 2025. (VINOD S.
