1.PUBLIC PROSECUTOR The Court made the following Order: This Criminal Petition, u/See.480 & 483 of the Bharatiya Nagarik suraksha sanhita, 2023, has been filed by the Petitioners/Al to A3, seeking bail, in Crime No.63/2025 of J.Madugu Police Station, Y.S.R. District. 2, A case has been registered against the Petitioners for the Offence punishable u/sec. 303(2) of the Bharatiya Nyaya Sanhl'ta, 2023. 3, Heard learned counsel for the petitioners and the learned Assistant public prosecutor representing the respondent/State. 4.

On 30.01.2025, the-~c/e facfo complainant reported that in the Premises Of Canara bank, Jammalamadugu town, some unknown offenders committed theft of bag which was containing 4 Thulas of Gold articles worth Rs.2,00,000/- of the de facfo complainant, when she went to mortgage her gold items in the above said bank. 4. Learned counsel for the petitioners contended that petitioners have been in judicial custody from o2.02.2025, by this time most of the investigation might have been completed and further detention of petitioners is not required. He further contends that the 3rd petitioner is a woman having a child of 9 months baby girl, no one is there to take care of that girl and prays to allow the criminal petition. 5. On the other hand, learned Assistant Public Prosecutor opposed tO grant bail to the petitioner. He further subm'lts that investigation is at crucial stage and the petitioners have several previous antecedents against them,

Considering the submissions made and on perusal of the material on record, it is n,oticed that the learned Magistrate has not granted bail to the Petitioners On the ground that there are several cases against them. It is submitted that the 3rd petitioner is a woman aged about 21 years having a child of 9 months baby girl and no one is there to take care of that girl. Hence, this Court is of the opinion that by this time most of the investigation might have been completed pertaining to the role played by the 3rd petitioner in the present crime. It is submitted that the 3rd petitioner has permanent abode `=- `_ ` -i-_ I
3 and there I'S nO POSSibility O-i her fleeing away from justice and the release of the petitioner would not cause tampering of evidence and hampering of investigation. As such, this Court is inclined to grant bail to the 3rd petitioner. 7.
In the result, the criminal petition is partly allowed with the following conditions: i. The 3rd petitioner/3rd accused herein shall be released on bail on her executing a personal bond for Rs.1O,000/-(Rupees ten thousand only) with two (02) sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Jammalamadugu; and ii. That the 3rd petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses and she shall cooperate with the investigation. '"til.
