Pursuant to the directions contained in the order dated 05.06.2025, whereby Sri. Mrinmoy Kumar Bhattacharjee, Retired District & Sessions Judge, Assam was proposed to be appointed as an Arbitrator who will decide the dispute arising by and between the parties subject to furnishing of a written declaration, today the parties have placed before the Court the written declaration under Section 12(1) of the Arbitration and Conciliation Act, 1996 dated 19.06.2025, whereby the proposed Arbitrator has expressed no difficulty or handicapped for being appointed as an Arbitrator. The copy of the written declaration is kept on the case record. In that view of the matter the arbitration petition stands allowed and disposed of. Sri. Mrinmoy Kumar Bhattacharjee, Retired District & Sessions Judge, Assam is appointed as an Arbitrator to decide on the dispute arising by and between the parties pursuant to the Contract Agreement No. CWE/TEZ(859)/02 of 2018-19. The copy of the said disclosure is also available in the case record as was submitted by the learned prospective Arbitrator to the Registry. Thereafter, the learned Arbitrator will initiate the proceedings. The Arbitration Petition is disposed of in terms of the above.
