Petitioner's father died while performing election duty during Covid-19 period. Claim was initially instituted for payment of compensation in terms of the State policy by the mother and despite such claim being admitted the amount was not released. The mother ultimately died. It is the son who has ultimately been paid the amount of compensation on 04.01.2025. Learned counsel for the petitioner submits that payment of interest is necessary concomitant of the delay in payment of amount and, therefore, petitioner is entitled to payment of interest at the rate of nine percent. Reliance is placed upon a judgment of this Court in Writ C No. 28249 of 2021 (Kusum Lata Yadav Vs. State of U.P. and 4 Others). This Court has directed payment of interest on such delayed claim. It is after filing of two writ petitions and a contempt that the claim of the petitioner was actually accepted by the State. In the facts of the case, considering the judgment in the case of Kusum Lata Yadav (supra) as also the subsequent direction issued by this Court in Writ Petition No.23247 of 2022 (Smt. Neelam Singh Vs. State of U.P. and 2 Others), we hold that petitioner would be entitled to payment of interest at the rate of nine percent per annum from the date of moving of application/ filing of the representation dated 12.02.2023, by the wife of the deceased, for compensation. Such amount will be calculated and paid to the petitioner within a period of three months. In view of the observations made above, the present writ petition is disposed of.
