( 2025:HHC:30884 ) IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA FAO(FC) No. 54 of 2025 Date of decision: 10 th September, 2025 Suresh Kumar …Appellant Versus Anjali Thakur …Respondent. Coram The Hon’ble Mr. Justice Vivek Singh Thakur, Judge. The Hon’ble Mr. Justice Sushil Kukreja, Judge. Whether approved for reporting? For the Appellant: Mr. R.L. Chaudhary, Advocate. For the Respondent: Mr. Sahil Thakur, Advocate. Vivek Singh Thakur, Judge Appellant, despite granting opportunities, has failed to comply with the order by making payment of entire arrears of maintenance to the respondent, as directed vide order dated 10th July, 2025 with rider that failure in compliance shall result into dismissal of appeal for want of compliance. 2 On request of learned counsel on 7th August, 2025, time was further extended and case was ordered to be listed for today. 3 Today, learned counsel for appellant submits that order was duly communicated to the appellant, but till date appellant could not deposit the maintenance amount, as directed by the Court. 2 ( 2025:HHC:30884 ) 4 In view of above, it appears that appellant is not interested to contest the appeal and therefore, is not complying with order passed by Court. Accordingly, appeal is dismissed for non- prosecution as well as for want of compliance. Pending miscellaneous application(s), if any, also stand disposed of accordingly. (Vivek Singh Thakur), Judge. 10th September, 2025(ms) (Sushil Kukreja), Judge.
