1. Prayer in the instant civil writ petition filed under Articles 226/227 of Constitution of India is for issuance of a writ in the nature of certiorari for setting aside the order dated 22.08.2025 (Annexure P-9), passed by Tehsildar, Beri, District Jhajjar, whereby warrants of possession have been issued against the petitioner. 1.1 A further prayer has been made for directing respondents not to execute the warrants of possession during the pendency of appeal (EA-284/2025), pending before learned Commissioner, Rohtak Division, Rohtak (in short 'Divisional Commissioner').

2. Learned State counsel submits that infact the stay application filed by the petitioner alongwith his appeal already stands rejected, vide
order dated 08.08.2025, passed by learned Divisional Commissioner. Learned State counsel has filed copy of said order in Court today, which is taken on record subject to all just exceptions and copy thereof has been handed over to learned counsel for the petitioner.
3. At this stage, learned counsel for petitioner submits that he may be permitted to withdraw the instant writ petition with liberty to avail his remedy, as available to the petitioner, against order dated 08.08.2025, passed by learned Divisional Commissioner.
4. Ordered accordingly.
