Judgment 06/03/2025
1. Heard.
2. This appeal is directed against the order passed by the learned Single Judge rejecting the prayer for interim relief.
3.
Learned counsel for the appellants would submit that without formulating the issues for complaint, order impugned was passed mechanically, which has not been properly appreciated by the
[2025:RJ-JP:10030-DB] (2 of 2) [SAW-157/2025] learned Single Judge while rejecting the application for interim relief. Reliance is placed on the decisions of this Court in the cases of Rajasthan Tennis Association through its President Vs. Rajasthan Cooperative Societies and Others, 2007 SCC OnLine Raj 963 and B.R. Soni (Dr.) & Another Vs. State of Rajasthan & Others, 2020 (1) RLW 575 (Raj.).
4. It is not a case where entire complaint as it has been reproduced in the order and mechanically enquiry order has been passed. Framing of points of complaint, prima facie, shows that the authority applied its mind and thereafter directed enquiry. On such considerations, interim relief, as prayed for, has not been granted.
5. Therefore, we are not inclined to interfere with the discretion of the learned Single Judge in refusing the grant of stay. The observations made hereinabove are limited only for the purpose of deciding the appeal and shall not come in the way of decision of the writ petition on its own merits.
6.
Learned counsel for the appellants submits that the enquiry, if any made, may be made subject to final outcome of the writ petition.
7. Once, the court has issued notice, it goes without saying that the outcome of the enquiry will be subject to final outcome of the writ petition.
8. Appeal is, accordingly, dismissed.
