1. After hearing learned counsel for the parties, it is seen that during the pendency of this appeal, some crucial witnesses have been examined. We find out that at the time when the order impugned dated 12.11.2024, was passed, only 18 out of 28 witnesses stood examined. However, during the pendency of the appeal, 04 more witnesses have been examined and their testimony would be relevant to be taken note of while considering the plea of the appellant for bail.
2. Since the trial Court is seized of the matter and has now before it the statements of 22 witnesses, we are of the considered opinion that it would be appropriate for the appellant to approach the trial Court by way of a fresh application. Ordered, accordingly.
3. Needless to say that, in case the appellant files fresh bail plea in view of the changed circumstances, i.e. recording of statement of 04 more witnesses, the same shall be considered on merits by passing a reasoned order.
