In this interlocutory application, under Order 1 Rule 10(2) of the C.P.C., the applicants have prayed for striking out the name of the respondent No. 1(2) from the array of the MAC App. No. 721/2022. 3. Mr. Khan, learned counsel for the applicants referring to Annexure – 1, at page No. 8 of the petition, submits that the opposite party Nos. 1(2) Jebun Nissa Ahmed suffered demise on 09.01.2024 and her legal representatives are also Page No.# 3/3 impleaded in the MAC App. No. 721/2022. As such, there is a requirement for striking out the name of the said respondent from the array of the said appeal. 4. The learned counsel for the opposite parties submits that they have no objection in the event of allowing this application. 5. Taking note of the submissions of learned counsel for both the parties, this court is inclined to dispose of this application by striking out the name of the respondent No. 1(2) from the array of the MAC App. No. 721/2022. 6.
