The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to quash the entire proceedings of complaint case No. 3827 of 2019 as well as cognizance/summoning order dated 29.1.2020, whereby learned magistrate took cognizance under Sections 147, 148, 149, 324, 325, 354-B, I.P.C., Police Station Khurja Nagar, District Bulandshahr, pending in the court of Special Judge (SC/ST Act) Bulandshahr. After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
