Mahesh Chandra Pant, Member/Mediator This is a petition under Section 482 Code of Criminal Procedure, 1973, by which, the petitioner has challenged the proceedings under Section 313, 323, 498A of IPC and 3/4 of Dowry Prohibition Act. On the basis of the charge sheet the court below has taken cognizance and issued process on 31.05.2021. Both the parties are present. The statements of both the parties are being recorded which are annexed herewith. They have stated that they have received the money in pursuance of the compromise as mentioned in paragraph no.7 of the petition. 2. In the matter of the Seema Bansal vs. Dr. Mayank Bansal the Hon’ble Supreme Court in (2008)16 SCC 607 observed to the effect that the parties having agreed that they will withdraw all the civil/criminal cases, the Hon’ble Supreme Court has directed that the criminal complaint arising from FIR under Section 498A IPC shall be permitted to be withdrawn by the applicant. 2 3. Both the parties have filed a compromise deed before the Daily Lok Adalat which runs as under:- “ उपरोƅ वाद आज िदनाक 02.01.2025 को लोक अदालत मŐ लगा Šआ था िजसमŐ उपरोƅ प्राथŎगढ़ों का समझौता हो गया है िजसमŐ दोनों के बीच यह समझौता Šआ है िक दोनों अलग रहŐगे और दोनों के बीच जो मुक़दमे हœ उɎŐ वापस िलया जायेगा और वादी Ȫारा प्रितवादी को 10.10.2022 को 10 लाख ŝपए िडमांड डŌाɝ Ȫारा िदए गए हœ िजसे प्रितवादी Ȫारा प्राɑ कर िलया गया है तथा अब दोनों ही पƗ उपरोƅ मुक़दमे को आगे नहीं चलना चाहते है I दोनों के मȯ समझौता हो गया है तथा कोई भी ŝपया लेना नहीं है व भिवˈ मŐ दोनों कोई भी मुकदमा नहीं करŐगे I अतः महोदय से िनवेदन है िक उपरोƅ वाद का िनˑारण िकया जाए I धɊवाद िदनांक 02.01.2025 प्राथŎ हˑाƗर वादी/ प्रितवादी” 4. Consequently, the petition under Section 482 Cr.P.C. stands allowed and the proceedings stand quashed by virtue of the settlement between the parties. 5. Accordingly as settled between the parties and identified by both the parties. 6. In view of the above compromise, the award is passed accordingly.
