ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus, declaring the action of the respondent no. 3 herein in not following Section 41-A of Cr.P.C as well as the Verdict of the Apex Court (Arnesh Kumar Vs State of Bihar) while investigating the matter in FIR No. 86 of 2019 Dated 14.12.2019 on the file of the SHO PS Varadayapalem, Chittoor District, Andhra Pradesh, as illegal, arbitrary and also contemptuous in nature consequentially direct the respondent no.3 herein to scrupulously follow Section 41-A Cr.P.C and the guidelines issued by the Apex Court (Arnesh Kumar Vs State of Bihar) while investigating the matter in FIR No. 86 of 2019 Dated. 14.12.2019 on the file of the SHO PS Varadayapalem, Chittoor District, Andhra Pradesh.”

Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that Section 41-A Cr.P.C notice was issued to the Petitioners in connection with FIR No.86 of 2019 on the file of Varadayapalem Police Station, Chittoor and investigation has been completed in the said crime and charge sheet has also been filed. Hence, the relief sought has become infructuous. 3. Sri K.Viswanatham, learned counsel for the Petitioners would submit that the Court may pass appropriate orders. 4.
Considering the submissions made, the Writ Petition is dismissed as the relief has become infructuous. There shall be no order as to costs.
