The present petition has been filed for the following relief: "1) Issue a writ order or direction in the nature of mandamus commanding and directing the Respondent No. 2/ Additional Chief Judicial Magistrate, Ghazibpur to decide the Municipal Appeal no. 13 of 2007 (Narendra Nath Vishwakarma & others Vs. President Nagar Palika Parishad, Ghazipur & others) filed by the petitioner/s father and others under section 160 of Municipalities Act, Mohalla Saklenabad City Ghazipur, District Ghazipur expeditiously within stipulated period as fixed by this Hon'ble Court." 3. Contention of learned counsel for the petitioner is that the Municipal Appeal No. 13 of 2007 is pending consideration and he prayed that the same may be decided expeditiously. 4. From perusal of the order sheet, annexed as Annexure No. 3 to the petition, it appears that several dates have been fixed by the Court concerned, however, till date, the aforesaid appeal has not been decided. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to Additional Chief Judicial Magistrate, Ghazipur, to decide the aforesaid appeal, in accordance with law, expeditiously, preferably, within a period of one year from the date of production of a certified copy of this order, after hearing all the concerned parties provided there is no other legal impediment.
