The Court made the following: 2 THE HONOURABLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2269 of 2025 ORDER: The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short “B.N.S.S”) has been filed by the petitioner/Accused No.1, seeking quashment of the proceedings against him in Crime No.76 of 2025 of Gannavaram Police Station, Krishna District registered under Section 420, 407, 467, 468, 120b r/w 34 IPC. 2. The petitioner is alleged to have committed offences under Section 420, 407, 467, 468, 120b r/w 34 Indian Penal Code, 1860(for short “I.P.C.”). 3. It is alleged that the petitioner while discharging his duty, an officer of District Mines and Geology has directed the 1st respondent to supply gravel for official function of the State and that the bills were paid to an enterprise by name “Babu Enterprises”. Non-payment of bills to the 1st respondent alleging that the petitioner has committed the alleged offences, the police have registered the case. 4. Learned Assistant Public Prosecutor appearing for the State submits that police has registered FIR on 25.02.2025 and the police need to complete the investigation to ascertain the facts. 3 5. Learned counsel appearing for the petitioner submits that bills were cleared in the name of “Babu Enterprises” and that the concerned Assistant Executive Engineer, Deputy Executive Engineer and Executive Engineer of the concerned division have cleared the bills for the work done by said “Babu Enterprises” as such, the petitioner has no role insofar as non-payment of the alleged bills. 6. Considering the same, since the punishment for the offences registered against the petitioner are more than 7 years, the SHO and IO of Gannavaram Police Station, is directed to complete the investigation without taking any coercive steps against the petitioner. The petitioner is to co-operate with the investigation. 7. With these observations, the Criminal Petition is disposed off. There shall be no costs.
