…. for the petitioner
Mr. Arindam Sen,
Ms. Sima Biswas.
…. for the State
1. Petitioner submits he has been falsely implicated in a series of cases. Accordingly, he prays for anticipatory bail.
2. Learned Counsel for the State opposes the prayer for anticipatory bail.
3. Inspite of notice nobody appears for the victim.
4. We have considered the materials on record including statement of the victim girl. Victim had earlier lodged case against the petitioner alleging outraging of modesty. In the present case it is alleged victim was again accosted and harassed the victim.
5. Keeping in mind the facts and circumstance of the case, we are of the opinion though custodial interrogation is not necessary but movement of the petitioner requires to be restricted in order to prevent commission of similar offences in future.
