The Court made the following Order:
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in trying to dispossess the petitioners from their respective house sites in Sy.No.321/1B3 to an extent of Ac.0.02 ½ cents situated at Byluppala Village, Gonegandla Mandal, Kurnool District bearing Plot Nos.66, 64, 62, 59, 65 and 63 respectively and to allot the same to the third parties. 3. The learned counsel for the petitioners submits that the petitioners are threatened by the 4th respondent to dispossess them from the subject plots illegally without following the due procedure. 4. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that, specifically the petitioners are not in possession of the house site plots bearing Nos.58, 59, 60, 63, 64 and 65 by way of huts/houses in the said plots. They are claiming the Government land by obtaining irregular pattas. The petitioners are not houseless and they are having houses of their own in the village and residing in their houses.
There were no huts and also houses in the plots mentioned by them as represented by the petitioners. The 4th respondent confirmed that the pattas are not genuine and they are irregular pattas. 5. In view of the above said facts and circumstances and upon consideration of the rival submissions made, as the petitioners are not having

allotted house sites and as they are not genuine pattas, no relief can be granted in this writ petition. 6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
