Issue a writ, order or direction in the nature of mandamus directing the Respondent No. 2 i.e. Sub Divisional Officer, Tehsil Sadar, District Prayagraj to decide the recall application for recalling the ex-parte order dated. 25.06.2021 passed in proceeding under section 38(1) of U.P. Revenue Code 2006 and further direct to parties concerned to maintain status quo with regard to possession and nature over the land in question during the pendency of the recall application pending before the court of Respondent No. 2." 2. It is contended by learned counsel for the petitioner that a restoration application is pending in proceedings under Section 38(1) of the U.P. Revenue Code, 2006, for consideration before the respondent no. 2. The sole prayer made is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, without calling for counter affidavit, with a direction to the respondent no. 2- Sub Divisional Officer, Tehsil Sadar, District Prayagraj to decide the restoration application in proceedings under Section 38(1) of the UP Revenue Code, 2006, in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits. September 15, 2025 A. V.
