The petitioner has filed the present writ petition under Articles 226/227 of the Constitution of India with a prayer to issue a writ in the nature of certiorari for quashing the order dated 29.11.2024 (Annexure P-11) passed by the respondent No. 2, whereby, the retirement age of the respondent No. 5 has been considered as 60 years. A further prayer has been made to set-aside the disability certificate 22nd March 2022 (Annexure P-6), which was allegedly procured by way of fraud by respondent No. 5. 2. During the course of hearing, learned State counsel has placed on record a communication in vernacular dated 01.09.2025, which has been sent by Civil Surgeon, Saheed Bhagat Singh Nagar to the Director, Health and Family Welfare, Punjab, in which it has been AMIT RANA 2025.09.03 17:05 I attest to the accuracy and authenticity of this judgement/order CWP 25490 of 2025 -2- mentioned that an application has been received from Dr. Kulwinder Kumar, Senior Medical Officer-respondent No. 5. As per the said application, Dr. Kulwinder Kumar, Senior medical Officer has stated that he was not claiming the extension of service till the age of 60 years on the basis of that disability certificate and he does not wish to continue in service beyond 31.10.2025. The respondent No. 5 also requested the civil surgeon that his disability certificate may not be taken into account while granting the extension of period of 02 years in service. The respondent No. 5 has also requested that the retiral benefits may be ordered to be released to him after his retirement on 30.10.2025. Photocopy of the said communication dated 01.09.2025 is taken on record. 3. Learned State counsel further submits that since the respondent No. 5 has already prayed for discontinuing his service, w.e.f. 31.10.2025, no benefit can be allowed to him in such a case. 4.
