The primary grievance of the petitioner is that the order of suspension dated Page No.# 2/2 09.10.2023 issued by the authority placing him under suspension has not been reviewed within the stipulated period of 90 days by following the due procedure of law and the petitioner was kept illegally under suspension. 2. Mr. T. C. Chutia, learned Standing counsel, Assam State School Education Board submits that the departmental enquiry against the petitioner has already been concluded and by order dated 19.06.2025, the penalty of Compulsory Retirement in terms of the provision of Rule 7 (v) of the Assam Services (Discipline and Appeal) Rules, 1964 has been imposed upon the petitioner. It was further decided that the pay and allowance of the petitioner during suspension period shall be limited to the subsistence allowance already paid to him. 3. In view of the aforesaid, in the considered opinion of this Court, nothing survives to adjudicate in the present writ petition. 4. Accordingly, this writ petition stands closed. 5. It is needless to say that the petitioner shall have liberty to approach the appropriate forum for redressal of his grievance against the order dated 19.06.2025. 6. Copy of the order dated 19.06.2025 issued under the signature of the Secretary to the Assam State School Education Board, Division-I, Bamunimaidam, is kept on the record. 7. Copy of the same has also been furnished to the learned counsel for the petitioner. JUDGE Comparing Assistant
