Mr. Aakib Ahmed, learned counsel for the petitioner. 2. Mr. Narayan Dutt, learned Standing Counsel for the State of Uttarakhand. 3. Mr. Neeraj Garg, learned counsel for respondent-UPNL. 4. Petitioner was engaged through an outsourcing agency, namely, UPNL in State Tax Department to discharge duties as Date Entry Operator. According to him, he served as such nearly fifteen years. 5. By means of this writ petition, petitioner has sought the following reliefs:- (i) Issue a writ order or direction in the nature of Certiorari quashing the impugned order dated 29.02.2024 (Annexure-2) issued by respondent. (ii) Issue a writ order or direction in the nature of Mandamus commanding and directing the respondents not to remove the petitioner from their occupied post as the petitioner already have served the State Tax department for 15 years in sanctioned and vacant post and he is having all requisite qualification/eligibility for the post and further in view of the judgment and orders passed by this Hon’ble Court in WP (PIL) 116/2018 titled Kundan Singh Vs State & others and judgment and order passed by Hon’ble Supreme Court in Secretary State of Karnataka & others VS Uma Devi and others (2006) 4 SCC 1 and Narendra Kumar Tiwari & others VS State of Jharkhand and others (2018) 8 SCC 238. 2025:UHC:7843 6. Learned counsel for the petitioner submits that identical controversy has been decided by this Court in WPSS No. 524 of 2025, vide judgment dated 20.08.2025, therefore, he submits that this writ petition may also be decided in terms of the said judgment. 7. Learned State Counsel concedes that dispute is identical in both the cases and submits that he has no objection if the present writ petition is also decided in terms of the aforesaid judgment. 8. Accordingly, the writ petition is disposed of in terms of the judgment dated 20.08.2025 rendered in WPSS No. 524 of2025.
