CRM-M-47703-2025 1 219 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-47703-2025 Date of Decision: 03.09.2025 PARVINDER ALIAS PHUNNI ......... Petitioner Versus STATE OF HARYANA …..... Respondent CORAM: HON'BLE MR. JUSTICE YASHVIR SINGH RATHOR Present : Mr. Arvinder Arora, Advocate for the petitioner. Mr. Ramesh Kumar Ambavta, DAG, Haryana. **** YASHVIR SINGH RATHOR , J. (Oral) 1. This is first petition under Section 483 of BNSS, 2023 for grant of regular bail in case FIR No.54, dated 09.05.2025 (Annexure P-1), registered at Police Station Shahzadpur, District Ambala, under Sections 115(2), 117(2), 126(2), 190, 191 (3), 324(2) and 351(2) and 110 of BNS, 2023. 2. Learned counsel for the petitioner has been heard and material collected by the police during investigation has been perused. 3. The present case was registered on the basis of complaint given to the police by Arun Kumar @ Anil Kumar with the allegations that on 06.05.2025 at about 7:50 PM, he was going to Shahzadpur alongwith elder brother Abhishek and friend Sushant in his car. He was going to purchase a tractor and was, thus, carrying a sum of Rs.3, 30,000/-. When they reached Sadiqpur, liquor shop at about 8 PM, ASGAR ALI 2025.09.03 16:38 I attest to the accuracy and integrity of this document CRM-M-47703-2025 2 two persons were standing in front of the shop and they were travelling in one car bearing registration No. HR06AM5922 Maraca Brezza and he does not know registration number of other car. Ravi @ Babad came out of the Brezza car alongwith sword in his hand and stopped his car as he had a grudge against him as he wanted to marry a girl related to her. When he stopped the car, Ravi hit him on his head with a sword. Thereafter, 8-10 people came out of both the cars who were armed with swords and iron pipes. One Manir attacked him on his head with a sword. Thereafter, Ravi attacked him on his head for the second time which hit his head as a result of which he fell down. Thereafter, Parminder attacked on his right leg several times with an iron pipe and Anuj gave blows with an iron pipe on his right leg. Thereafter, all the boys started beating him with iron pipes. Thereafter, Ravi and Manir gave sword blows on his head with an intention to kill him but he raised his arm to defend himself and the sword hit his arm on which, he fell unconscious and all the assailants ran away. 4. Learned counsel for the petitioner argued that petitioner has been falsely implicated in the present case. Similarly situated co-accused namely Anuj to whom blow on the right leg with an iron pipe was attributed has been released on anticipatory bail by this Court vide order dated 11.08.2025. Petitioner is also attributed blows with iron pipe on the leg and his case is identical to that of co-accused Anuj. Petitioner is in custody since 01.06.2025 and since similarly situated co-accused has been released on anticipatory bail, he is entitled to be released on regular bail. Learned counsel next contended that investigation and trial of the case is certainly going to take sufficiently long time to conclude and in ASGAR ALI 2025.09.03 16:38 I attest to the accuracy and integrity of this document CRM-M-47703-2025 3 these circumstances, further detention of the petitioner is not required and he deserves to be released on bail. 5. On the other hand, learned State counsel, on instructions from ASI Baldev Raj, has opposed the bail and argued that petitioner has committed a heinous offence and he does not deserved the benefit of bail. 6. Petitioner is in custody since 01.06.2025 and as per allegation in the FIR, he had allegedly caused blows with an iron pipe on the leg of victim. The similarly situated co-accused namely Anuj has already been released on anticipatory bail by a Coordinate Bench of this Court. The investigation and trial of the case is certainly going to take sufficiently long time to conclude and in these circumstances, further detention of the petitioner is not required and he deserves to be released on bail. 7. Having regard to the aforesaid factual position, but without commenting anything on the merits of the case, the bail application is allowed and petitioner is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of learned Trial Court/Duty Magistrate concerned, on usual terms and conditions. (YASHVIR SINGH RATHOR) JUDGE 03.09.2025 Ali Whether speaking/reasoned Yes/No Whether Reportable Yes/No ASGAR ALI 2025.09.03 16:38 I attest to the accuracy and integrity of this document
