Petitioners apprehend their arrest in a case registered for the offence punishable under sections 316 (5) , 318 ( 4 ), 338 and 3 (5) of the BNS. 3 . As per F.I.R., informant namely , Pinki Kumari alleged that all the F.I.R. named accused persons including these petitioners, fraudulently withdrawn the government money of the Pradhan Mantri Awas Yojana (Gramin) by scanning the account number of competent beneficiaries and also tampered with the official records. It is submitted on behalf of these petitioners that the present F.I.R. was instituted on 02.06.2025 against these petitioners with the allegation that they defalcated Rs. 40,000/- of Pradhan Mantri Awas Yojana but on perusal of letter issued by the B.D.O ( Block Development Officer ), Baheri, the aforesaid amount of Rs. 40,000/- ( Forty thousand) which was received by these petitioners in the year 2019-20 has already been deposited on 26.09.2023 in the account of State Nodal Bank Account No. 431701000244 i. e ,. Annexure – P / 2 to the bail petition . Petitioners claim clean antecedent. 5 . Learned counsel for the State oppose the bail petition . 6 Considering the fact that the defalcated amount has already been deposited by these petitioners, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM- VII Darbhanga in connection with Baheri P.S. Case No. 207 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , Patna High Court CR. MISC.
