To issue a writ, order or direction in the nature of Mandamus commanding and directing the respondent no. 2 to decide case/restoration application case No. 1070 of 2023 filled in case No. 924/37/06 (Smt. Kalami vs. Samsahghat and others) under section 28 of U.P.L.R.Act, pending before the respondent no. 2, within stipulated period of time as fixed by this Hon'ble Court." 2. It is contended that restoration application is pending in proceedings under Section 28 of the U.P. Revenue Code, 2006. Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. 3. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2- Additional District Magistrate (Finance & Revenue), District- Kushinagar to decide the restoration application pending in proceedings under Section 28 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order. 4. With the aforesaid direction, present writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the case on merit.
