Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent, Mr. Sunil Kumar Dubey, learned counsel for the respondent nos.2 to 4 and perused on record. The present writ petition has been filed inter-alia for the following reliefs:- "1- To issue the writ order or direction in the nature of mandamus and commanding the respondents for issue the appointment letter to the petitioner in reliance of selected list as Annexure no.-1 to this petition. 2- To issue any other order or direction in the favour of the petitioner which deems fit and proper according to the circumstances of the case? 3- To award cost of the petition." Learned counsel for the petitioner submits that the petitioner appeared in the recruitment process for 12,460 Assistant Teacher posts in Primary Schools in Uttar Pradesh, in compliance with the Government Order dated 15.12.2016. In furtherance of the said recruitment process, a final list of selected candidates was published on 27.12.2023 for the purpose of document verification, subject to counseling and fulfillment of all eligibility criteria. As per the requirement, the petitioner had duly completed the TET examination, and the result was declared accordingly. The petitioner also submitted the TET certificate dated 17.03.2017 to the concerned authorities. And 3 Others .....Respondent(s) However, despite repeated efforts, the appointment letter has not been issued to the petitioner till date. Learned counsel for the petitioner further submits that despite the petitioner's name appearing in the selection list published on 27.12.2023, the appointment of the petitioner to the post of Assistant Teacher has not been considered by the authorities, without assigning any reason or issuing any communication to the petitioner. The petitioner has submitted multiple representations from time to time, but the same have not been responded to, and the authorities have remained silent on the issue. Therefore, a direction may be issued to the concerned authorities to issue the appointment letter to the petitioner, in accordance with law. On the basis of instructions, learned counsel for respondent nos. 2 to 4 submits that the petitioner completed her Teacher Eligibility Test (TET) on 17.03.2017. However, as per the eligibility criteria stipulated in the Government Order dated 15.12.2016, the requisite qualification, i.e., the TET, ought to have been completed prior to 15.12.2016. Learned counsel for respondent nos. 2 to 4, on the basis of instructions received, submits that the petitioner is not entitled to the relief as prayed for, for the following reasons as stated in the instructions placed before this Court today: "जनपदीय चयन सिमित के सदस्यों के समक्ष आहूत काउिन्सिलग में उपरोक्त अभ्यिथयों के अिभलेखों की जाँच में िनम्निलिखत तथ्य प्रकाश में आयेl 1. क्रम संख्या 3 पर अंिकत श्रीमती ज्योित द्वारा अध्यापक पात्रता परीक्षा 17.03.2017 को उत्तीणर् िकया गया है सिचव उत्तर प्रदेश बेिसक िशक्षा पिरषद प्रयागराज के पत्रांक बे०िश०प०/12836-12932/2016-17 िदनांक 20.12.2016 (संलग्नक-1) में यह उिल्लिखत िकया गया है िक "पिरषदीय प्राथिमक िवद्यालय में 12460 सहायक अध्यापकों के चयन के चयन/िनयुिक्त हेतु ऐसे अभ्यिथयों द्वारा ऑनलाइन ई-आवेदन िलये जाने के िनदेर्श िदये गये है जो शासनादेश िनगर्त होने की ितिथ िदनांक 15.12.2016 तक भारत में िविध द्वारा स्थािपत िवश्विवद्यालय से स्नातक के साथ िद्ववषीर्य बी०टी०सी०/िविशष्ट बी०टी०सी०/िद्ववषीर्य उदूर् प्रवीणता बी०टी०सी० प्रिशक्षण / डी०एड० (िवशेष िशक्षा) / चार वषीर्य बी०एल०एड० उत्तीणर् िकये हों एवं उ०प्र० सरकार अथवा भारत सरकार द्वारा आयोिजत कक्षा 1-5 हेतु अध्यापक पात्रता परीक्षा सफलतापूवर् उत्तीणर् कर चुके हों।" इस प्रकार श्रीमती ज्योित द्वारा अध्यापक पात्रता परीक्षा िनधार्िरत ितिथ 15.12.2016 के उपरान्त 17.03.2017 को उत्तीणर् होने के कारण चयन/िनयुिक्त हेतु पात्र नहीं हैl" In view of the above, the present writ petition is misconceived and it is, accordingly, dismissed. WRIA No. 13787 of 2025 2 However, the petitioner is at liberty to approach the Court in case she is aggrieved by the information given regarding his non-selection to the post of Assistant Teacher.
