The present petition under Section 439(2) Cr.P.C. has been filed for cancellation of the bail granted to respondent No.2 vide order dated 25.07.2023 in case FIR No.272 dated 30.11.2022, under Sections 354, 354- A, 354-D, 506, 509 of IPC and Section 12 of POCSO Act, registered at Police Station City Kapurthala, District Kapurthala. 2. Custody certificate filed by learned State counsel is taken on record. Learned State counsel while relying upon the contents of the affidavit of Senior Superintendent of Police, District Kapurthala, submits that bail granted to respondent No.2 in the aforesaid FIR was cancelled on 28.08.2024 as he had stopped appearing before the learned Trial Court and that non bailable warrants had also been issued against him in this regard. She further submits that respondent No.2 has since been arrested in case FIR No.85 dated 01.04.2025, under Sections 75(2), 78(2), 351(3) of BNS and KAPIL 2025.05.23 14:27 I attest to the accuracy and integrity of this document CRM-M-54266-2023(O&M) 2 Sections 8 and 12 of POCSO Act, registered at Police Station City Kapurthala and is in custody since 01 month and 7 days.
