Shahi, learned Additional Chief Standing Counsel for State- Respondents. 2. This writ petition is filed against order dated 01.08.2025 whereby petitioner was put under suspension. 3. Learned counsel for petitioner submits that in the years 2024 and 2025 three show cause notices were issued and petitioner has replied to each notice, as such reason in impugned order that none of the notices were replied, is contrary to record. 4. Learned Additional Chief Standing Counsel submits that inquiry will be concluded within three months though according to counsel for parties till date no charge sheet has been issued. 5. In aforesaid circumstances, at this stage, Court cannot enter into merit of case since matter is under consideration that it is a case of departmental proceeding. However, Court takes note that despite specific direction that inquiry report shall be submitted within three months, till date even charge sheet has not been submitted. 6. In view of above, the writ petition is disposed of with following observations/ directions: Versus Counsel for Petitioner(s) : Ajay Mishra, Noor Saba Begum, Shri Krishna Mishra Counsel for Respondent(s) : C.S.C. Anil Kumar Sharma .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) (a) If charge sheet is not submitted within a week from today, suspension order dated 01.08.2025 shall be kept in abeyance. (b) In case charge sheet is submitted within a week and after reply of petitioner, with his further cooperation, inquiry report is not submitted within eight weeks thereafter, the suspension order shall be kept in abeyance.
