Mr. Bhupesh Kandpal, Advocate for the petitioners. Mr. Suyash Pant, Standing Counsel for the State. Mr. B.D. Pande, Advocate for the respondent no.2. Heard. It is the case of the petitioners that they are licensed meat vendor. Their slaughter house in Nagar Palika, Ramnagar, District Nainital, has been closed. Due to closure of the slaughter house, the petitioners are not able to carry out their business of sale and purchase of meat. The petitioners now propose to purchase meat from the slaughter house at Sambal, District Moradabad, but police at Kashipur, District Udham Singh Nagar, has objected to it. The petitioners have already given a joint application to the Sub Divisional Magistrate on 10.07.2025, which is Annexure No.4 to the writ petition, which has yet not been decided. Learned counsel for the petitioners submits that the petitioners have license to run meat shop, but their slaughter house at Ramnagar has been closed; they cannot run their business; they have to bring meat from slaughter house at Sambal, District Moradabad, and they have been given such permission by Nagar Palika, Ramnagar on 14.07.2025, which is Annexure No.5 to the writ petition, but he submits that police is interfering into their activities and since police has been interfering into their business, now, Nagar Palika, Ramnagar, has cancelled the No Objection Certificate, which they had given. He submits that he had given a representation on 10.07.2025 to the respondent no.3/Sub Divisional Magistrate, Ramnagar (“the SDM”), but no action has been taken on it; in fact, pursuant to the representation, the Nagar Palika, Ramnagar, had further given in writing that they had given No Objection Certificate to the petitioners, but it was cancelled on 07.04.2025. He further submits that the respondent no.3/the SDM may be directed to take a decision on the representation dated 10.07.2025, Annexure No.4 to the writ petition. Learned State Counsel submits that the representation dated 10.07.2025, which is Annexure No.4 to the writ petition, will be decided by the respondent no.3/the SDM within a period of two weeks. The Court takes on record the statement given by learned State Counsel. The writ petition is disposed of with the direction to the respondent no.3/the SDM to decide the representation dated 10.07.2025, which is Annexure No.4 to the writ petition, within a period of 2 weeks from today, in accordance with law.
