1. Heard Mr. S.N.Tamuli, learned counsel for the petitioner Md. Riku Ali who has filed this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail since he is behind the bars from 16.02.2025 in connection with Mathurapur Police Station Case No. 33/2024 ( GR No. 274/2024) under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

2. Heard learned Additional Public Prosecutor Mr. D.P. Goswami for the respondent State who has raised serious objection. There are incriminating materials against the petitioner.
3. I have considered the submissions at the Bar with circumspection.
4. I have scrutinized the Case Diary.
5. It is submitted on behalf of the petitioner that no active role has been attributed against the petitioner in the FIR. The petitioner is also willing to co- operate with the remaining part of investigation. The petitioner is willing to abide by any stringent condition if imposed upon him.
6. As the petitioner is willing to co-operate with the remaining part of the investigation, the prayer for bail is allowed.
7. The petitioner named above shall be enlarged on bail on furnishing a bail bond of Rs.50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Charideo, Sonari under the conditions that:- (i)The petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation, (ii)The petitioner shall not leave the jurisdiction of the Court without prior permission.
8. On breach of any of the bail conditions, learned court is at liberty to immediately cancel the bail granted to the petitioner.
9. In terms of the above observations, the Bail Application stands disposed of.
