The present petition has been filed with the following prayer:- “Issuance of a writ, order or direction in the nature of mandamus for directing respondent No.3 to refer the Reference Petition dated 26.12.2022 (Annexure P-3) filed under Section 30 of the Land Acquisition Act, 1894 to the learned District Judge, Gurugram, to be adjudicated as per provisions of Section 30 of the Land Acquisition Act, 1894, which the Land Acquisition Collector is duty-bound to refer as per provisions of Section30, if there is any dispute as regards apportionment.” 2. Notice of motion in the present case was issued on 29.08.2025. 3. Today, learned State counsel, upon instructions from respondent No.3-Ms. Anupama Malik, Land Acquisition Officer, Gurugram, informs that the reference petition preferred at the instance of petitioners- SONIKA 2025.09.09 11:07 I attest to the accuracy and authenticity of this document CWP-25309-2025 (O&M) --2-- landowners filed under Section 30 of the Land Acquisition Act, 1894 (for short, “1894 Act”) shall be forwarded to the learned Reference Court of competent jurisdiction within three weeks from today. 4. In view of the aforesaid stand taken by learned State counsel, the present petition is disposed of. 5. Respondent No.3 shall remain bound by the undertaking extended before this Court to forward the reference petition within three weeks from today. It is made clear that in case, respondent No.3 fails to abide by the same, she shall be liable to pay a sum of Rs.50,000/- to the petitioners, which shall be recoverable as arrears of land revenue. 6.
