The petitioner has filed this application under Section 483 of the BNSS, 2023 with prayer for bail as he is behind bars since 12.03.2025 in connection Page No.# 2/3 with Fatasil Ambari Police Station Case No. 51/2025 under Sections 87 of the BNS. 3. Heard Mr. K. Baishya, learned Additional Public Prosecutor, Assam for the respondent State. 4. It is submitted by the learned counsel for the petitioner that the FIR clearly reveals that the victim went with the petitioner on her own volition. Moreover, the allegation in the FIR is a false allegation as the petitioner and the victim were proceeding to celebrate birthday. It is further submitted that the petitioner is only 19 years old. 5. I have considered the submissions at the Bar with circumspection. 6. I have also considered the age of the petitioner and the submission that the petitioner is willing to co-operate with the remaining part of investigation. 7. Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs. 50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Kamrup (M), under the conditions that: (i) The petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation, (ii) The petitioner shall not exercise threats to the witnesses, and (iii) The petitioner shall co-operate with the investigation. 8. On breach of any of the bail conditions, the learned Court is at liberty to Page No.# 3/3 immediately cancel the bail granted to the petitioner. 9.
