JUSTICE HARISH KUMAR ORAL ORDER 2 02-12-2025 Heard learned Advocate for the petitioners and learned APP for the State. 2. The petitioners apprehend their arrest in connection with Dulhin Bazar P.S. Case No. 32 of 2021 registered for the offences punishable under Sections 147/148/149/341/379/ 325/323/337/307/504/506 of the I.P.C.

The allegation against the petitioners is of causing assault by means of lathi, bricks and stones along with other accused persons due to which the informant and others have sustained serious injuries. 4. Patna High Court CR. MISC. No.82002 of 2025(2) dt.02-12-2025 2/3 of the road, unauthorizedly. There is counter version of the present case bearing Dulhin Bazar P.S. Case No. 33 of 2021 instituted against the informant and his family members. On the fateful day on account of reason aforenoted, the parties have entered into a free-fight resulted into injuries to persons of both sides. However, the prosecution has failed to explain the injury allegedly sustained to the persons of the petitioners’ side. Referring to the injury report, a copy of which is placed on record as Annexure-P/3 series, it is submitted that out of three persons, two of them have sustained simple injury. So far as the injury which is sustained to one Madheshwar Paswan @ Maheshwer Prasad, out of two injuries one of the injury has been found to be grievous in nature but the same is on non-vital part. It is next contended that the reason to implicate the name of the petitioners is only because they are facing two criminal antecedents, however, in both cases the petitioners are on bail. 5.
On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the FIR was instituted long back in the year 2021 and the specific allegation levelled against the petitioners. However, they have come up for anticipatory bail after four years. 6. Having considered the submissions advanced by

No.82002 of 2025(2) dt.02-12-2025 3/3 the learned Advocate for the respective parties and taking note of the nature of accusation qua the injuries sustained to the injureds, besides factum of case and counter case and the genesis of the occurrence, let, the above named petitioners, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur in connection with Dulhin Bazar P.S. Case No. 32 of 2021, subject to the condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioners and further subject to the verification of the antecedent of the petitioners with further condition that if the petitioners shall found indulge in such activities in future, the informant or the State shall be at liberty to file application for cancellation of their bail. shailendra/- (Harish Kumar, J) U T
